Terms and Conditions

These Terms & Conditions govern the use of Ember Heritage's services. By instructing us or purchasing our services, you confirm that you have read, understood and agreed to these Terms & Conditions.
1. About Us
Ember Heritage provides estate planning document preparation services throughout England and Wales.
References to "we", "our" and "us" mean Ember Heritage.
References to "you" and "your" mean the client.
2. Our Services
We prepare legal documents based solely on the information supplied by you.
It is your responsibility to ensure that all information provided is complete, accurate and up to date.
3. Your Responsibilities
You agree to:
● Provide accurate and truthful information.
● Respond promptly to requests for additional information.
● Carefully review all draft documents.
● Inform us of any amendments required before giving final approval.
● Ensure all documents are signed correctly where applicable.
We cannot be held responsible for errors arising from inaccurate or incomplete information supplied by you.
4. Draft Documents
Draft documents are provided for your review and approval.
It is your responsibility to ensure all details are correct before confirming that the documents are final.
Once final approval has been given, responsibility for checking the contents transfers to you.
5. Amendments
Reasonable amendments requested before final approval are included within our service.
Requests for additional work after final approval may incur additional charges.
6. Missing Information
If required information has not been provided, we may be unable to prepare or issue your documents.
Any delays caused by missing information supplied by the client shall not be the responsibility of Ember Heritage.
7. Cancellation & Cooling-Off Period
Under the Consumer Contracts Regulations 2013, you have the right to cancel your agreement within 14 days.
For the purposes of our services, the 14-day cooling-off period begins on the date of your appointment.
If you wish to cancel, you must notify us in writing before the end of the cooling-off period.
If you have requested that we begin work during the cooling-off period and work has already commenced, we reserve the right to deduct a reasonable amount reflecting the work completed up to the date of cancellation, in accordance with the Consumer Contracts Regulations 2013.
Nothing in these Terms & Conditions affects your statutory rights.
8. Fees & Payment
Our fees will be agreed with you before work begins.
Payment must be made in accordance with the payment terms agreed at the time of purchase.
Failure to make payment may result in work being suspended.
9. Refunds
Refund requests will be considered in accordance with UK consumer law.
Where work has already commenced, any refund may be reduced to reflect work completed.
Once documents have been approved and finalised, refunds will not normally be available unless required by law.
10. Confidentiality
We treat all client information as confidential.
Your information will only be used to provide the services you have requested or where required by law.
11. Data Protection
We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR).

12. Limitation of Liability
Our liability shall be limited to the amount paid for the services provided, except where liability cannot legally be excluded.
We shall not be liable for:
● Information supplied incorrectly by the client.
● Delays caused by third parties.
● Delays caused by government organisations.
● Documents signed incorrectly.
● Changes in legislation after documents have been prepared.
● Losses arising from failure to review draft documents before approval.
13. Complaints
If you are dissatisfied with any aspect of our service, please contact us as soon as possible.
We will investigate your complaint promptly and aim to resolve it fairly.
14. Intellectual Property
All documents, templates, branding, website content and materials remain the intellectual property of Ember Heritage unless otherwise stated.
They may not be reproduced or distributed without our written permission.
15. Force Majeure
We shall not be responsible for delays or failure to perform our obligations where such delays arise from circumstances beyond our reasonable control, including but not limited to natural disasters, illness, technical failures, industrial action or government restrictions.
16. Governing Law
These Terms & Conditions shall be governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
